IntelFetch Copyright & Intellectual Property Notice

1. Copyright Ownership

All content, data compilations, databases, software, source code, visual designs, trademarks, logos, text, graphics, and other materials available on or through IntelFetch (the "Platform") are the exclusive property of Cintel Solutions AB (org. nr. 559532-7023), operating under the brand name IntelFetch, or its licensors, and are protected under applicable intellectual property laws, including but not limited to:

  • Swedish Copyright Act (Upphovsrättslagen, SFS 1960:729), which grants exclusive rights to reproduce, distribute, and make available literary, artistic, and compiled works.
  • EU Directive 2001/29/EC (InfoSoc Directive) on the harmonisation of certain aspects of copyright and related rights in the information society, as implemented in Swedish law.
  • EU Directive 96/9/EC (Database Directive) on the legal protection of databases, granting sui generis database rights to the maker of a database who has made a substantial investment in obtaining, verifying, or presenting the contents.
  • EU Directive 2019/790 (DSM Directive) on copyright and related rights in the Digital Single Market.

2. Prohibition on Copying, Scraping, and Reproduction

Strictly Prohibited

No part of this Platform, including but not limited to text, data, database contents, compilations, search results, API responses, software, graphics, logos, and page layouts, may be copied, reproduced, republished, downloaded, posted, transmitted, scraped, crawled, data-mined, or distributed in any form or by any means without the prior written consent of Cintel Solutions AB, except as explicitly permitted in Section 3 below.

The following activities are expressly prohibited without prior written authorisation:

  • Copying or reproducing any content, data, or database contents from the Platform for any purpose, whether commercial or non-commercial.
  • Scraping, crawling, or automated extraction of data or content from the Platform using bots, spiders, scrapers, or any other automated means.
  • Creating derivative works based on content or data obtained from the Platform.
  • Mirroring, framing, or embedding any part of the Platform on any other website or service.
  • Redistributing, sublicensing, or reselling data, search results, or any content obtained from the Platform.
  • Systematic downloading or storing of content or data from the Platform for the purpose of building a competing database or service.

These prohibitions apply regardless of the method used to access the Platform, including but not limited to web browsers, APIs, scripts, automated tools, or manual copying. Any extraction or re-utilisation of a substantial part of the contents of the IntelFetch databases is strictly prohibited under the sui generis database right granted by EU Directive 96/9/EC, Articles 7–11, and as implemented in Swedish Copyright Act (SFS 1960:729), Chapter 5.

3. Permitted Use: IntelFetch API

Authorised Access

The sole exception to the prohibitions in Section 2 is access through the official IntelFetch API at api.intelfetch.net. Authorised API users are permitted to integrate IntelFetch data into their own applications, products, and services, subject to valid API credentials and compliance with the Terms of Service and applicable API usage agreements.

Authorised API users who hold valid API keys and maintain an active subscription may access, retrieve, and use data through api.intelfetch.net to build and operate their own services. This includes, but is not limited to, integrating API data into custom applications, dashboards, security tools, and other products. Such use is permitted in accordance with the following conditions:

  • Usage must remain within the scope and rate limits defined by the user's subscription plan and API agreement.
  • Users may build and operate their own services, applications, and products that consume IntelFetch API data, provided they comply with the Terms of Service and their API agreement.
  • Raw bulk data obtained through the API may not be resold or sublicensed as a standalone dataset. However, presenting API data as part of a value-added service or application is permitted.
  • API access does not grant any ownership rights over the underlying data. All intellectual property rights remain with Cintel Solutions AB and its licensors.
  • Users are responsible for ensuring that their use of API data within their own services complies with all applicable laws, including GDPR and other data protection regulations.

Any use of the API that exceeds the authorised scope or violates the Terms of Service constitutes a violation of this Copyright Notice and applicable copyright law.

4. Enforcement and Legal Action

Cintel Solutions AB actively monitors for unauthorised use, copying, scraping, and reproduction of its content and data. Violations will result in legal action.

Cintel Solutions AB reserves the right to take any and all legal action available under applicable law against individuals, companies, or entities that infringe upon its intellectual property rights. Enforcement measures may include, but are not limited to:

  • Cease and desist notices demanding the immediate cessation of infringing activities.
  • Civil proceedings seeking injunctive relief, damages, and account of profits under the Swedish Copyright Act (SFS 1960:729, Chapter 7) and EU Directive 2004/48/EC (Enforcement Directive).
  • Criminal complaints under Swedish criminal copyright provisions (SFS 1960:729, Chapter 7, § 53), which provide for fines and imprisonment for intentional copyright infringement.
  • Claims for damages including actual damages, lost profits, and reasonable legal costs in accordance with Swedish and EU law.
  • Immediate termination of any accounts, API keys, or access credentials associated with the infringing party.
  • Reporting to relevant authorities, including law enforcement agencies and national cybercrime units.

Cintel Solutions AB employs technical measures including access logging, rate monitoring, and automated detection systems to identify and document unauthorised access, copying, and data extraction. Evidence collected through these systems will be used in legal proceedings.

5. Database Rights

In addition to copyright protection, the IntelFetch databases are protected by sui generis database rights under EU Directive 96/9/EC and corresponding Swedish law. Cintel Solutions AB has made a substantial investment in obtaining, verifying, and presenting the contents of its databases.

Under these rights, the extraction (permanent or temporary transfer of all or a substantial part of the contents of a database to another medium by any means or in any form) and re-utilisation (any form of making available to the public all or a substantial part of the contents of a database) of the IntelFetch databases are prohibited without explicit written authorisation. Repeated and systematic extraction or re-utilisation of insubstantial parts that conflict with a normal exploitation of the database or unreasonably prejudice the legitimate interests of the database maker are also prohibited under Article 7(5) of EU Directive 96/9/EC.

6. Trademarks

"IntelFetch", the IntelFetch logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cintel Solutions AB or its affiliates. You may not use such marks without the prior written permission of Cintel Solutions AB. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

7. Governing Law and Jurisdiction

This Copyright Notice shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Copyright Notice shall be subject to the exclusive jurisdiction of the Swedish courts, with Malmö District Court (Malmö tingsrätt) as the court of first instance.

Nothing in this Copyright Notice shall limit the right of Cintel Solutions AB to seek injunctive or other equitable relief in any jurisdiction where infringement occurs or is threatened.
